Terms of Service

Important Notice

By creating an account, generating code, or using any feature of ApexStudioBuilder, you fully and irrevocably agree to all terms below, including all liability limitations and disclaimers. If you do not agree, do not create an account and do not use the Service.

1. Acceptance of Terms

By accessing, creating an account with, or using ApexStudioBuilder.com ("the Service", "the Platform", "we", "us"), you enter into a legally binding agreement with ApexStudioBuilder and accept these Terms of Service ("Terms") fully and without reservation.

This acceptance explicitly includes, but is not limited to:

  • All liability limitations as described in these Terms
  • Your full own responsibility for the use of generated code
  • Waiving claims against ApexStudioBuilder for any damages
  • The obligation to review, test and validate generated code yourself

If you do not agree with any part of these Terms, you are not permitted to use the Service. Continued use after becoming aware of these Terms constitutes explicit acceptance.

2. Description of the Service

ApexStudioBuilder is an AI-based platform for generating Salesforce Apex classes. The Service includes:

  • Generating Apex classes and accompanying test classes via AI
  • Version management of generated code
  • Marketplace for buying and selling Apex classes
  • Affiliate program for user referrals
  • Library with information and best practices

The Service is intended solely as a tool. All generated code is a starting point and requires professional review before being used in production environments.

3. COMPLETE LIABILITY LIMITATION AND DISCLAIMER

READ THIS SECTION CAREFULLY. BY USING THE SERVICE YOU ACCEPT THESE LIMITATIONS FULLY AND IRREVOCABLY.

3.1 No Warranty on Generated Code

All code generated by ApexStudioBuilder is provided "AS IS" and "AS AVAILABLE", without any warranty of any kind, express or implied. We expressly DO NOT warrant:

  • That the code is free from errors, bugs, or vulnerabilities
  • That the code is suitable for any specific purpose or use
  • That the code meets security standards or compliance requirements
  • That the code functions correctly in your specific environment
  • That the code is compatible with other systems or APIs
  • That the code is safe for use in production environments
  • That the code does not infringe on third-party rights
  • The accuracy, completeness or reliability of the code

3.2 Complete Exclusion of Liability

ApexStudioBuilder, its owners, employees, partners and affiliated parties are UNDER NO CIRCUMSTANCES liable for:

  • Direct, indirect, incidental, special, consequential or punitive damages
  • Loss of data, revenue, profits, goodwill or business opportunities
  • Business interruptions or failures
  • Security breaches or data leaks caused by generated code
  • Damage to systems, databases or infrastructure
  • Third-party claims resulting from your use of the code
  • Costs for recovery, replacement or correction of code
  • Legal costs or fines related to the use of the code
  • Any other damages, regardless of whether we were aware of the possibility

This exclusion applies regardless of the legal basis (contract, tort, negligence, strict liability or otherwise) and even if we have been advised of the possibility of such damages.

3.3 API Integrations and External Systems

If you use generated code for building API integrations, connections with external systems, or integrations with platforms such as Salesforce:

  • You are fully and solely responsible for the operation and security
  • You bear all risks associated with the use of these integrations
  • You accept that ApexStudioBuilder bears no responsibility for functionality
  • You are responsible for compliance with third-party API terms
  • You indemnify ApexStudioBuilder from all claims arising from this

3.4 Security is Your Responsibility

THE SECURITY OF ALL GENERATED CODE IS SOLELY AND COMPLETELY YOUR OWN RESPONSIBILITY.

This means you:

  • Are responsible for security audits of all generated code
  • Must identify and fix vulnerabilities yourself
  • Must conduct penetration tests and security reviews yourself
  • Are responsible for encryption, authentication and authorization
  • Must ensure compliance with security standards (SOC 2, ISO 27001, etc.) yourself
  • Are responsible for protecting personal and sensitive data

3.5 Maximum Liability

If, despite the above exclusions, ApexStudioBuilder is held liable for any reason, total liability is in all cases limited to the amount you paid us in the 30 days prior to the claim, with an absolute maximum of €50 (fifty euros).

4. Your Obligations

As a user of the Service you commit to:

  • Thoroughly reviewing all generated code before using it
  • Conducting adequate tests in non-production environments
  • Having security reviews conducted by qualified professionals
  • Independently validating the code against your specific requirements
  • Making necessary modifications for your use case
  • Complying with all applicable laws and regulations
  • Protecting your own systems and those of your clients

5. Indemnification

You fully indemnify ApexStudioBuilder, its owners, directors, employees, partners, suppliers and affiliated parties from and against all claims, demands, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising from or related to:

  • Your use of the Service or generated code
  • Your violation of these Terms
  • Your violation of third-party rights
  • All acts or omissions in connection with your account
  • Claims from your clients, employers or other third parties
  • Security incidents related to your use of the code

6. Account and Registration

To use the Service you must:

  • Be at least 18 years old or have reached the age of majority in your jurisdiction
  • Be authorized to enter into legally binding agreements
  • Provide a valid email address
  • Choose a secure password and keep it confidential
  • Provide accurate and complete information

By creating an account you confirm that you have fully read, understood and accepted these Terms, and that you are authorized to enter into this agreement.

7. Tokens and Payments

7.1 Tokens

The Service operates on a token system. Tokens are used for generating Apex classes. Tokens:

  • Are not transferable to other users
  • Are not redeemable for money
  • Do not expire as long as your account remains active
  • Cannot be reclaimed upon account termination

7.2 Payments and Refunds

All payments are processed through Stripe. Prices are in Euros (€) and inclusive of VAT where applicable. All purchases are final. We do not offer refunds, reimbursements or credits, except where required by law.

8. Marketplace

8.1 Selling

As a seller in the Marketplace:

  • You must have a valid Stripe Connect account
  • You receive 80% of the sale price
  • The platform deducts 20% as a service fee
  • You are fully responsible for the quality and security of your code
  • You warrant that you have the rights to sell the code
  • You indemnify ApexStudioBuilder from buyer claims

8.2 Buying

As a buyer in the Marketplace:

  • You get access to the purchased code
  • You are responsible for reviewing and testing purchased code yourself
  • You may not resell or redistribute the code
  • You accept that purchased code has the same warranty limitations as all other code

9. Affiliate Program

The affiliate program:

  • Offers 10% commission on purchases by referred users
  • Tracking via cookie (valid for 30 days)
  • Minimum payout: €50
  • We reserve the right to modify, suspend or terminate the program
  • We reserve the right to withhold commissions if fraud is suspected

10. Intellectual Property

10.1 Your Content

You obtain a non-exclusive license to use the Apex classes generated by you. This license is conditional on your compliance with these Terms.

10.2 Our Content

The Service, including all software, algorithms, design, text and images, is owned by ApexStudioBuilder and is protected by intellectual property rights.

11. Prohibited Use

You may not use the Service to:

  • Conduct illegal activities
  • Distribute malware or harmful code
  • Disrupt, overload or damage the Service
  • Mislead or defraud other users
  • Send spam
  • Reverse engineer or copy the Service
  • Create multiple accounts for fraudulent purposes
  • Manipulate the affiliate program

12. Termination

We may immediately and without prior notice terminate or suspend your account if:

  • You violate these Terms
  • You engage in fraudulent behavior
  • You abuse the Service
  • We deem it necessary for any other reason

Upon termination you immediately lose access to your account, tokens and all content, without right to refund or compensation.

13. Modifications

We may modify these Terms at any time. Changes take effect upon publication on this page. It is your responsibility to regularly check the Terms. Continued use of the Service after changes means acceptance of the modified Terms.

14. Severability

If any provision of these Terms is declared invalid or unenforceable, the remaining provisions remain in full force. The invalid provision will be replaced by a valid provision that most closely approximates the original intent.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and ApexStudioBuilder regarding the Service and supersede all prior agreements or understandings.

16. Governing Law and Disputes

These Terms are governed by and construed in accordance with Dutch law, without regard to conflict of law principles.

All disputes are exclusively submitted to the competent court in Amsterdam, The Netherlands. You waive any right to participate in class actions against ApexStudioBuilder.

By creating an account at ApexStudioBuilder you confirm that you:

  • Have fully read and understood these Terms of Service
  • Agree to all provisions, including the liability limitations
  • Understand that you are fully responsible for the use of generated code
  • Understand that security is your own responsibility
  • Waive claims against ApexStudioBuilder for damages arising from use
  • Are authorized to enter into this legally binding agreement
